legal definition of occupancy

Hi all,
would anyone have any idea what "shared occupancy" means in relation to a tenancy agreement, in terms of a legal definition.
I am currently renting through a co-operative rental scheme who are implying having a guest stay is in breach of a section of the lease which states they must be notified in advance if their are any changes in residents of the property in particular in relation to shared occupancy. They are stating this refers to a person staying 2 nights or more on a regular basis. although there is no mention of an amount of visits in the lease. They said it is not in the lease because it is a policy, but they could not point me to where this policy was in writing or when it was put in place. Any advice ???

If they can't show you this 'policy' in writing then they can't enforce it. Your tenancy agreement is your contract, abide by that and you're fine

thanks for your reply, that's what I thought but they are stating you are if you breach their policies you are in breach of the lease. Really I think they are making it up as they go along and I'm going to have to get a solicitor on to it :-(
 
You did the right thing askign to see the policy.
You should also ask why this wasn't made clear when you took up the lease.
You might ask them does this apply to all there leases and do their leasholders know this.
Then you might suggest that you would undertake freely to inform all their tenants of this restrictive, apparently unwritten, "policy".

I just found out they brought this new policy in before meeting me. So all the tenants do not know, they are currently looking into changing the next lease!!
