left job but still being paid

Someone I know left a job about 2 months before they would have been made redundant. They started a new job but the original company continued to pay them, they informed the company & asked them to cancel payment however they haven't done that yet. whats the legal position there, the person is obviously going to pay back the overpayment but out of curiosity are they obliged to do so?

Strictly speaking I think, yes, they are obliged to do so. It can be argued both ways, but your friend is receiving money by mistake, and that mistake does not give him/her legal entitlement to own that money.
