Hi There.
If a client has a judgment registered against their property and passes away. Is the judgment cleared from sale proceeds of the property before their estate is divided among their next to kin or does the judgment die with them?
Also, how long does a judgment last and can it be renewed?

In partial reply a judgment does not extinguish on death and will have to be cleared first in event of sale. Otherwise the purchase would acquire the property subject to the judgment. Not sure re length of time before it becomes cancelled.

The Citizens Advice website says a creditor has 12 years to enforce a Judgment. I have a feeling, and i maybe wrong, that if the creditor takes any steps to enforce then the 12 years run from that date.
