Judgement in Default - Deadlines

Hi all,

I am the Plaintiff in a legal dispute about a joint property. My claim is to remove another party who has washed their hands of a property in negative equity and has failed to pay any expenses for 5 years. After many attempts to resolve it, I finally issued proceedings (a Civil Bill), they have failed to reply so my solicitor issued a motion for judgement in default of appearance.

However I am struggling to understand the process, rules, timelines, etc. if anyone could please explain? It is greatly appreciated!

My understanding is that I will get a court date for an uncontested decision/judgement (say March 2021). However the defendant can still submit an 'appearance' and a 'defence' right up to this date. Is that correct? It seems bizarre for them to ignore all deadlines and still submit a defence at the last minute or is there any hard deadline where they lose the right to submit a defence? Bare in mind, their intension is to drag it out to the limits of the system.

Thanks in advance for any comments!
