Hi there.
I applied for JBA the 1th of september 2009 and 2 weeks ago Welfare sent me this letter:

Dear Mr,

I refer to you your recent claim for Jobseekers Allowance.

Until to you to your claim has been approved for payment, you will be
required to sign at this office on a monthly basis.
Your next signing day will be on thursday 5th of november between
10.30am - 12.00 pm at hatch number 5

If your claim has been approved for payment before the above signing
date, you do not need to sign on the above day. You will receive a
further letter confirming a different signing date and time.

If you are unable to attend you may either discuss the matter further
with me or write to explain why you are unable to attend.

Failure to contact this office may result in your claim being
closed.

You will either get another letter exactly like that one with a December signing on date, or else, if your claim is approved in the meantime you will get a letter telling you that it has been approved & what your new signing arrangements are. Depending on what stage your claim is at you may get one asking for further documents etc or a further interview, but basically you just wait to hear from them, & do whatever they require.

Have you applied for Supplementary Welfare Allowance to tide you over in the meantime?

Yes...I applied for SWA and they refused my application because I dont meet the habitual residency conditions. I went to Crosscare and they made for me an appeal. I received a letter today: the appeal officer can't allow my appeal because my rent is greater than the maximum level set for single person sharing and Im not living here continously for 2 years but just for 19 months. Im still looking for a job and in the meantime Im praying God for the JBA. Do you think I have a little possibility?
 
Sorry to hear that. The habitual residence rule applies to Jobseekers Allowance also, but the decision on whether or not you satisfy this rule is made by an officer employed by the DSFA (as it’s a social welfare payment), whereas the decision regarding you not satisfying it for Supplementary Welfare Allowance was made by an officer employed by the HSE (as it’s a health board payment).

Given that it’s a bit of a grey area on whether people satisfy the habitual residence rule (& by that I mean there are different factors taken into consideration) or not, you might satisfy the conditions in the eyes of the officer deciding your application for Jobseeker’s Allowance – then again you might not. You have the right to appeal if you are refused.

If your application is refused you should still sign on for PRSI ‘credits’, which will maintain your social insurance record for any future claims. You must have paid or credited PRSI contributions in either of the last two tax years to get 'credits' with Jobseeker's Allowance. If you are unemployed but not entitled to a social welfare payment you can sign on for credits if you are available for & capable of work.

The Health Service Executive takes all the facts of your situation into account before deciding whether to make this payment. Note that you are unlikely to get money to pay for predictable or regular expenses such as rent.

Why the HSE refused me my claim and my appeal?
 
It looks to me as if you applied for & were refused basic SWA plus rent supplement. I don't know whether or not you applied for an Exceptional Need or Urgent Needs payment, & it's pointless just speculating as it will be of no help to you.

Therefore I suggest you go to your nearest Citizens Advice Centre, bring all correspondence from HSE with you & ask them for advice on what your options are in that regard.

Alternatively you could go back to the Community Welfare Officer & ask them exactly what you have applied & been refused for, & if you can apply for an Exceptional or Urgent Needs payment.
