I'm caring for parent (widowed) in our home who has dementia. It was the family home but put into joint ownership with myself. One sibling decided to take parent to live elsewhere & refuses to allow return even though parent's wish was to remain at home. Missed 2 appointments for cognitive test because of this. When I visit, I have the sibling sitting beside parent constantly. I haven't worked for almost a year & will be taking legal advice as the EPA can't go ahead without this test. I suspect some wrongdoing. I also think this sibling has persuaded the other siblings that I coerced parent into the joint ownership arrangement & this is why I have no support in getting the parent back home where there is a HSE home-care package in place. My question is: can I refuse to sign the nursing home loan (part 5) of the application even though it says that the absence of prior consent in writing of a joint owner does not render void the making of a charge in favour of the HSE?
