Item purchased now not "as described" - my options.

Purchased an item but few weeks later have now discovered a specification of the item I was told by seller was in it, is not.

I contacted seller highlighting Sale of Goods......was looking for refund of the value of the difference between the item having this spec and not having it etc.

seller contacted me and decided he would take back my new item.

Do I have to accept the seller option or .......... Anyone any help to me. Thanks.
 
The law entitles you to a repair, replacement or refund for such goods. The option of which remedy is at the sellers's discression. See here.

finally sorted last week.....

May help someone with a consumer issue but had purchased new car telling me car had central locking but had to wait for electronic key to be ordered, left the forecourt with manual key. Months later second manual key arrived after looking for central locking key a few times.

Anyway salesman said he do a full refund which I didnt think was the acceptable as I loved the new one etc. Anyway luckily i contacted the manufacturer of the car and they suggested to fit some sort of an alarm and finally have central locking (although fob not on the key) and range not great ie you need to be fairly near the car to open it but better than having two arms full or worse carrying toddler/baby and having to manually open the car, plus the scratches I built up on the drivers door is unbelievable and also car technology guys said I was lucky the lock didnt give as they're not built for manual opening.

Hopefully I won't see another consumer issue for good few years.....
 
maybe try small claims court if the party does not respond
