I have recently being looking into buying agriculture land in poland to put into production. But the law in poland states that no foreigners are permitted to own ag land in poland. Is there anyway around this issue? has anyone got any experience of purchasing ag land in the eu ?
any advice would be very much appreciated

My understanding is that the law on this is due to change on May 1st 2009. It was a protection policy against speculation when Poland first entered the EU. The dificulty is the prices will surely increase substantially after this date. You should be able to buy through a company now though you'll need to check what percentage shareholding, if any, must be held by a Polish national

Generally no foreigner is able to purchase an agricultural land during 12 years since Poland joined the EU (1.05.2004). There is a possibility to apply to a minister and get the permit. There might be some land availiable through PAIZ also.

The best way should be to set up a Polish limited company (spolka z o.o.) and purchase the land on it's behalf.

@TRMA: Errrr.... there is a slight possibility after 1st January 2009 when not only Poland but also Ireland will become an euro-region rather than an independent state. As result the Polish law will have the power similar to Dublin County Council by-laws and could be easily overruled by the European law. We shall see.

If you are buying land through a company run it by a tax expert in Ireland as the company will be taxed on the sale and any money you take out of the company will also be taxed so you may be taxed twice.
