Internal promotions within company

An existing employee has been given a new title within the company, effectively a promotion, but this new position, that hadn't existed before has not been advertised internally, is this legal or just one of those things you have to live with it and get on with?

Can it reallistically be challenged if it is not legal?
 

they can do what they want... unless its the civil service , or there is a union to fight your corner....
