Inheritance Implications of buying French Property

I am looking at buying a French Leaseback property & wonder if my Irish will would be recognised under French law or if I will need to make a French will to ensure property will be inherited in full by my wife should I die. Any ideas ?
 
My idea is that you should ask your french notaire. Inheritance laws changed recently in France under Sarkosy and I think allow for disinheriting children but not 100% sure.

As far as I am aware, you do not need to make a French will, but without one this will cause complictions.

You should draw up a French will, in line with the successin laws in France, and alter your Irish will accordingly.

You need to take legal advice on this matter.
 
French law divides assets differently to Irish Law. Spouce and children inherit automatically where as in ireland they go to spouce. If you dont mind your kids benifiting, dont worry about it. Check McKeever & Son, Solicitors, they are the experts.


You can also set up an SCI. This is a small property company which allocates shares as you please. This over rides inheritance law.

We bought a place in France a couple of years ago. The notaire who handled the transaction also put in place (for a fee of €350 or thereabouts) a separate legal document called a marriage convention, by which it is recognised in French law that the property was bought by both partners and that full ownership rests with the survivor in the event of one passing away. This gets around the whole issue of wills.

We purchased our property in France 'en tontine', which can only be done at the time of purchase.

It basically means that if one married partner dies, the other one has full ownership of the property.

We did it this way because we have 1 child who is a minor and if one of us died and the other needed to sell the property, it would be difficult to sell as half the property would automatically belong to the child.
