Income tax of dead parent

The executor of my mother's will now tells me that income tax was not paid for the last 12 years of my mother's life and that I am liable for this. Is this correct? She has been dead 8 years and also, the executor of the will was the one who should have paid the income tax in the beginning (being the owner of the company from which she drew income). in addition, the revenue has never approached me about this matter. Does anyone know about this type of thing?

Are you the only/main beneficiary ?
Has the estate been distributed?
What was the value of the estate?
How has this problem come to light?

am one of two beneficiaries. Estate was distributed seven years ago. Has come to light recently but the executor refuses to say how nor to establish my liablity.

What was the value of the estate?

In general, well, executor has primary responsibility but if you took the benefit and if there is a liability ( and these things do happen) then should'nt you have some liability?

Is there a demand from Revenue? Whatever about not telling you how this has arisen ( and it could be something like a Revenue audit of the company) you cannot be asked to pay something without proof of demand.

To be honest, I haven't a clue how much the whole estate was worth. I know also that there was no audit of the company.

I have no problem with paying the money if liability is established but I just find it surprising that this has arisen after such a gap. Obviously I need proof before payment but that hasn't been forthcoming. So such a situation can indeed arise after 8 years and a person can still be liable? I thought it would be statute barred after 6?

I thought it would be statute barred after 6?
There is no statute bar with regard to the Revenue.
I would get the figures checked if I were you.

You say there is no statute bar with regards to the Revenue. Can you direct me to finding further information on this as I am very unfamiliar with all this?

You should get legal advice here.
It is up to the executor to check out the tax issues before the estate is distributed.
Once the estate is distributed I'm not sure that he or the Revenue have any legal right to reclaim it

Have a look at this
It is very longwinded but it supports your thoughts on the executors duties to discharge all taxes outstanding
