ID Design Solicitor's Letter

Following on from the posts on the ID Design saga from late last year, I wanted to post about the letter I received last week and see did any of their other former customers receive the same. Basically I got a solicotor's letter from a firm in Dublin representing ID Design threatening to issue court proceedings against me within the next six days, as according to them, I still owed nearly 600 to our Scandinavian friends. What happened was a long story, similar to the other posts, of service so bad that I just gave up on them after nearly a year chasing them. I bought a bookcase from them in July 03, and to this day, they still have not delivered all the components (modular bookcase) to me, as detailed out on the receipt. Therefore, I with held the balance of payment, until the delivery was made in full. The solicitor's letter claimed that ID Design had continually tried to contact me (what a joke) to get this money from me. I assume that since they have gone bust that the liquidators are in trying to settle any outstanding debts, and wrote back tot he solicitors explainingn the story and sending a copy of the letter I sent to the director Frank dated over a year ago (to which I got no reply of course).
I suppose I am wondering does anyone know if they have any case against me and also could this affect any credit rating I have (which is as yet untarnished) as the deposit I initially paid was by credit card?

Not sure about the legalities but it sounds like some cheek to be chasing you for payment in this situation. You should keep all documentation/correspondence relating to the case. Perhaps you should counter claim against them in the for a refund of the money that you already paid on the basis that they never fully delivered on their part of the contract (i.e. full delivery of the goods)?

Here's my 2cent:
If you initially paid by credit card and they didn't hold up to their end of the deal, i.e. deliver all the goods, then your credit card company should be able to intervene and get your money back. Pack up the goods you recieved, send them back and treat the experience as a lesson.

Thanks everyone for the replies.
To be honest, I have neither the time nor inclination to try to take them to court, although you are right, I would probably have a case against them.
I hadn't thought of following up with the credit card company - good idea.
And finally, although it is tempting to send the stuff to the solicitor's office, I am just not prepared to shell out any further money for transit costs.
I will await their reply with bated breath...

A Small Claims Court claim should not involve too much time, energy or cost in case that's putting you off.

I have already filed a claim with the Small Claims Court. The clerk called me and said there was no point. For a start (new this myself) the registered office of the business (Wiltoncliff Ltd.) is the same as the shop address, which has been vacant for some months now, and the 'for lease' sign has gone up in the last week or so.

Hi Brumajen,

First, since this is a civil case, I suggest you seek advice from your solicitor.

Secondly, I contacted the Dublin District Court this am and spoke to the Small Claims Registrar. I paraphrase his comments here: It is possible to take a Small Claims case against a company in recievership but its not advisable as the liquidator will simply return the documentation to the Registrar. In some cases where proceeding were in train befor the liquidation the Small Claims Judge throws out the case on hearing of the liquidation. And lastly even if a ruling is made against the liquidated company the Sherrif will return it stating that it is unenforceable.

We got a letter aswell, my partner rang to explain what had happened(that we had paid the balance in cash in the warehouse cos we had to collect the goods ourselves), their solicitor said he'd get back to us but he never did.........

As you can read in other posts here, we got screwed by ID Design and contacted our drecit card company. Within a week we were refunded the €1000 we had paid ID design for furniture. ID Design then had the cheek to call us and ask us did we still want the furniture delivered and that we would have to pay in advance.
Guess what i told them to do.
Look up my posts here in good deal/ bad deals and you'll get the number that they have given people.
Dont know if it still wors but you can call it and when you get the voice mail press # then 0000 is the code and # again and you'll here messages from all the other people who were screwed.

I am in a similar situation, but the Insurance company of my credit card (VISA -BOI), keep insisting that I am not entitle to the refund of my deposit, as 'the item was not either stolen or damaged' (!?!).
I know it is a bit late, but it's almost one year I am battling with them.
I provided all the originals, including CC statements and a Report signed and stamped by the Gardai, describing the fraud.
No joy.

Please I was wondering if would it be possible for you to give me some details regarding your case, so that I will present as a precedent against the insurance and try to win the battle.
I know is a lot to ask, but I am afraid is my last chance to see my 1,850 Euros back!!

You could try referring your bank to IFSRA to encourage them to get it sorted.

robydublin, does your card have (optional or complementary) theft or damage insurance? You can't claim on that.

You can however claim from your bank (not the insurance company) because the transaction itself was not completed. You authorised the transaction conditional on delivery of goods. The bank are party to this contract. Unfortunately, they may (reasonably) say you've left it too long to claim from them. If you originally contacted them in a reasonable time, but they said to contact the insurance company, I think you still have a strong case.

P.S. I understand you are annoyed, but your comment inciting people to slap a named person is probably not very wise.
