How can I remove my ex from mortgage?

Dear Askaboutmoney Team,
could you advise how can I remove my ex partner from mortgage/Property Deeds:
Key points of current situation:
- We were not married, were living together couple.
- Have 13 years old child.
- He never paid & contributed to a single monthly repayment, all went from my funds and account.
- He is not co-operating in any solutions offered. Just answering 50% is mine.

His is name on the deeds? If it is, then you have 2 issues, getting him off the mortgage and potentially off the deeds as well

Hi Lena

This is a very difficult situation.
He presumably would argue that he contributed to the upkeep of the family while you were together.

Have you sought maintenance? Have you taken legal advice?

He could move back into the house tomorrow as he does own half of it.

Don't let it drift. Talk to your solicitor. Start the process now but be prepared to reach a settlement which you will not like.

It's possible that you might be able to get an order or agreement that you keep the house in exchange for a cash payment to him and a waiver of any rights to maintenance for your child.

Would he get 50% of his rent paid for as well...if paying 50% towards his Ex's mortgage? Genuine question, not sure how these things work.

Or would the situation potentially be, he pays:
1. 50% EX's mortg
2. Maintenance - 50% of childs living expenses? Or pro rated based on both parents income?
3. 100% his own housing cost?

4. Relinquishes all ownership of former family home?
5. Relinquishes 50% of all of his assets including future assets (pension etc?)?
6. EX reliquishes 50% of all of her assets..incl future assets?

I know it prob depends on specific situation but what the typical broad split of things?

Whatever about the rest of your list, this would be very unlikely especially in a non-married situation. And not even necessarily the rule of thumb in a married situation. All of the issues that you raise are too dependent on the specific details of a case to generalise about as far as I know and in my experience. IANAL.
