I am sick with worry right now that the sale of our house could fall through.
An offer put on our house about 8 weeks ago, and just before the buyers signed contract it was discovered that the folio did not match the actual house site. It transpired that our site, neighbours site and the landowners remaining land were all shown to be 10 feet to the right on the folio maps. Sale held up until deed of rectification went through.
Final part was to be our neighbours mortgage lenders agreeing to this, as ours had done. We were 99% of the way there. So the bank sent out a valuer/surveyor who now discovered that the boundary fence between our two houses is in fact out by 1 foot, giving neighbours 1 foot of our garden down the garden length.
Its not a problem for us or our neighbours either way, each of us owns the house we bought 8 years ago, no one notived that the fence was out a bit. We will agree to the boundary that is actually there now.
Problem is that our buyers have given us until next friday to sort the original folio problem or they will pull out. They dont even know about new issue as we only found out yesterday. Bank don't know if they can sign off on the original folio discrepancy now. I feel as though we've been flattened, and that the sale will fall through.
Please can anyone tell me if they have had a similar experience and that it might be possible to solve this before next Friday? I am devastated and will loose the house that we hope to buy too.
