our house was on the market but didnt sell.in the beginning we asked our solicitor to draw down the deeds ,as we thought we would sell quickly.this hasnt happened,so do we just ask the solicitor to give the deeds back to the bank? and do we need something in writing from the bank to say they have them back? thank you
if you still have a mortgage and they are held as security then yes you can just tell the solicitor to send them back. they are likely to have been released on ATR (accountable trust release) so the bank will expect them to come back in. Its very common so there are standard forms that are completed between solicitor and bank
