Hit by car driven by unaccompanied Learner.

Hi,

If someones car is hit by a another car driven by a learner driving on their own (no fully-licenced passenger on board), what is the scenario ?

If for example, the learner was on the wrong side of the road, unable to stop, ran into the side of another vehicle and (most importantly)wasn't legally supposed to be driving anyway, how does it affect insurance ?

Garda was called to scene (but vehicles were moved before that happened, to allow traffic pass) and noted that driver had Provisional licence only. However, he basically said that 'you 2 sort it out amongst yourselves".

Insurance will pay out as normal.

The insurance may go after the learner later , but I have not seen any case of it yet.
 
Will the Gardai prosecute him ? I know they technically 'should', but does that happen in Ireland ?
