happy new year to all you AAM folk.

My husband paid in full for a guitar from a local trader. The trader was to order it in early October. He was given a twelve day waiting time but still has not received it. The guys has given many excuses but at this stage my husband just wants his money back. He's calling into the shop tomorrow. What's the best way to go about this? What are his rights?

Thank you

L

As you have probably worked out by now, paying in full up front was a huge mistake. Your only legal option is the Small Claims Court, though even if you win a case it can be very difficult to enforce a judgement. A negotiated solution is your best option, so get down there and use your powers of persuasion, though it will be very, very hard to get your money back.

Is there an alternative model he could take?

If you wanted to advise the make and model he was looking for I could perhaps recommend an alternative.

What kind of guitar? Is it an unusual model or collector's item? What kind of excuses has the dealer made? Is it an established music shop you are dealing with?
