got a phone upgrade but did not sign contract. Can I get out of contract??

A few months ago I upgraded my phone (meteor) it was for a years contract but I did not actually sign a contract form. Can I get out of the remainder of the contract because I did not sign the contract form or will I have to stay fro the remainder of the contract?
 
Do you mean you didn't sign the orginal contract, or that you didn't sign when you up graded?

When you get a fre up grade ( in o2's case ) you dont sign another contract, because in your orginal contract it does say it automatically signs you up for another year.

I got stung with this, 9 months into a contract got an upgrade and only found out afterwards, so I was with them for another year.

Would of been nice to be told this by o2 at the time, but as always i should of read the contract. I doubt you will be able to get out of it.
 
i remember at the time they wanted me to sign something though, they were quite insistant on it but I said Ii would come back in the morning do do it?
 
If you had already signed the orginal contract when you first got a bill phone with them it doesn't matter that you didn't sign when you upgraded. What they wanted you to sign this time was probably insurance.
 
You may find in the terms and conditions somewhere that if you buy an upgrade, even online, that purchase of same constitutes a new 12 month contract, even though you don't actually sign a document. Certainly was the case for me with O2 when I last upgraded.

Here are the relevant terms and conditions from Meteor's site:

The Term of this Agreement shall be for a Minimum Period of 12 months from the date of connection to the Network. This Term and Minimum Period will be extended for a further period of 12 months following any upgrade of your Equipment, which will include the re-execution or new execution of terms, or your acceptance in writing of any new terms and conditions

It appears that the requirement for a signature to extend the contract is an optional extra.

anybody ever here of unfair terms into a consumer contract An unfair term in a standard consumer contract is a term that is significantly weighted against the consumer. !!!
