Getting consent to purchase house

We are in the early stages of looking at a house that has a restriction on selling for 25 years without consent of the council (Section 90 Housing Act 1966). I assume that it is was bought as an affordable house?

I believe that the purchasers much show a housing need. How difficult is it to show this? We are renting but have an investment property in another county.

I don't want to go to the expense of getting a survey done if we won't be able to buy it anyway.

Usually you should not own another property.

I would talk to a local councillor or directly to the housing dept of the council. I think it is unlikely you will qualify.

That's a pity! Knew it was too good to be true. I might give them a call anyway. Do they do things like take your income into account?

Houses that have this restriction are usually old council houses that would have been initially rented and eventually purchased.

I don't think the council look into income etc.. If I remember correctly you have a sign a declaration that you don't currently own any property and you have to provide your PPS number with this form, so they do check it out. I would think having other property would automatically disqualify.

I bought a house last year which was subject to consent from the council. I think if your property is in another county and you are working in the county where your applying for consent from you may be ok.

I there is more restrictions on the vendor as they have to demonstrate that their tax affairs are in order, they have another property to live in and i think they have to sign something that they won't go back on a housing list again.

Call the local authority involved and ask. Thats what i did and the guy in charge was very friendly and helpful.
