someone i know was recently fined around 500 euro after the fire brigade was called when he was burning some garden waste at the back of his house. garden waste was all he was burning including old briars, bits of trees etc. has any right to appeal this decision

Backyard burning is dangerous, antisocial, and should be illegal.

Rightly so - what with the risks of fire spreading out of control to neighbouring properties, and the carcinogens and toxins released by the low temperatures involved in backyard burning.

See here for further info.

Backyard burning in itself is not illegal, though it is an offence to cause a nuisance due to air pollution. The Atmospheric and Noise Pollution Section of Dublin City Council deal with such complaints.

The Air Pollution Act 1987 obliges everybody not to cause or permit an emission in such a quantity, or in such a manner, as to be a nuisance or cause Air Pollution.

There is an additional obligation on business and other non-domestic operators to use the best practical means to prevent or limit emissions.
The Waste Management Act 1996 prohibits the burning of any waste except in accordance with a permit. The Local Authority may issue such permit for relatively small quantities, subject to conditions. ie burning of natural untreated wood by a sawmill for space heating.

You're not allowed do it here, I know that! A helicopter often flys around taking pictures of offenders.

You serious? Just sounds a bit paranoid .

What about the fire pits and other out-door fires? Surely they are allowed as long as you are not burning loads of waste in them.

gotsomenow is correct, the helicopter is around here all the time, can turn the corner just when you have the blaze going nicely. Had to douse the fire with a bucket of water only to discover it was ryanair going into Knock.

Michael O'Leary has now taken on the contract to take photos of fires from the air on all internal flights. Each successful prosecution is worth €15. Who said the man was not a genius?

You might want to print this handy guide off for the next time:

Cork Corporation have made an appeal to the likes of woodies/B&Q etc to voluntarily stop selling those fire chimneys/fire heaters etc that you can use out the back

What about those backyard chimneys for sale in Garden Centre's?

I remember reading an article about these a while ago, may have been in the Irish Times. Apparently if you looked at the amount of dioxins and other pollution produced by the number of these backyard burners sold in a single branch of Woodies, it equalled that of 2 or 3 waste incinerators about which we've heard so much protest.
