Garage in wrong place from planning drawings

Hi,

We're starting the process of selling our house and in the paperwork associated with it i've discovered that we've built the garage on the opposite side of the house than where it is mapped on the planning permission drawings. Is this a major stumbling block or is it an issue at all ??. Would i be better off waiting to sell until i've applied for retention or do i have to do that ..

If you have a planning permisison issue, it will surface sooner rather than later and will have to be dealt with. When you did the work you should have had a qualified person ( engineer/architect/similar) confirm that the works had been done in compliance with planning permission. You'll need that when selling. Its unlikely that you can now get that as it appears the works were not done in compliance with the permisison granted.

It is a major problem. Have a word with your solicitor who will advise more specifically.

You may have to apply for retention of alteration in planning permission. How long have you lived there? If over 7 years, I believe the retention bit is handy enough.
 
You may not have a planning problem. Unless it was very large, your garage might well constitute an exempt development. However, a development which would be exempt is not exempt if it contravenes the terms of a planning permission. You should consult an architect\engineer as a matter of urgency.
 
If the garage is visible from the front of the house it is not an exempted development.

You dont have planning for the garage and wont be able to sell without retention.

Appoint an architect (or technician) and expect to pay about 750-1200.

If you dont know any I can recommend one.
 
Just to clarify one point; Being "visible from the front of the house" would not of itself disqualify a garage from being exempted development. However, the garage cannot be build forward of the building line (i.e. must not be in front of the front wall of the house)

Just to clarify a couple of things, we do have planning permission for the garage but we built it a couple of years after the house was complete. A mistake on my part not referencing our planning drawings. We are in the house about 6 years and the garage front is visable from the front of the site. Do you know if a retention application takes 3 months like the full planning permission and what's involved..
