Found out my car has been clocked?

After an expensive part going in my car I traced it back to where it was last serviced and found out that my car was clocked. When I bought the car it had 58000 miles and the last serivce was 120,000 miles.

After seeing a solictor the garage has admitted fault and are offering me a same car (make and model with less miles) or my money back.

Am I entitled to my full purchase price back or will they take a years depreciation of the refund?

They admitted clocking it!? :eek: Or they admitted not identifying it as having been clocked? Isn't clocking a criminal offence?
 
clocking isnt an offence by itself, but selling a car while knowing it was clocked and not disclosing this information to the new owner is an offence. Stupid law but thats Ireland for you.
 
Did it look like it had covered 58,000 when you bought it? Curious to know.
NCTS will tell you the milage at the last NCT but will be cagey about disclosing the owner's name who presented it for NCT. For me I've given them names and they've confirmed who owned it at that time.
 
It was orginally an English car. The garage who sold it to me said they bought it from an importer and this is the 3rd car that has been found to be clocked!!!!!:) can you believe this. I want to know why they didn't check my car out for this after others came back clocked.
 
Take a full refund. Nothing less. Threaten Trading Standards. They will fall down like a house of cards.
 
If i take a refund will they depreciate the value of the car that I traded against for this car by one year. it has been one year since i bought this car
 
Was the dealer you purchased from a main franchised dealer or one of the smaller independent ones? I’d say you would have a better chance of getting fair compensation from a main dealer. It could be a genuine mistake on their part and they would have a reputation to protect. The smaller guys tend not to care too much and if they get grief or bad publicity then move 2 doors down and change their name.


This is becoming a bigger problem recently with the huge amount of cars coming in from the UK. Diesel Audi A4’s, Passat’s and BMW 320d’s seem to be the most common. Most are 2002, 2003 ex fleet and have covered huge motorway miles but nearly always seem to have 50-60K on them when on sale here.

If you do some research on the UK auction houses it is rare to see this type of car go through with less than 100K, even 150K on 4 year old cars is very common. This type of car hides the mileage well and it can be difficult to spot worn seats, pedals etc. Also it is mostly motorway mileage and cars are generally looked after so look pristine. So I would just take a little bit more care about buying a UK car and do some checking yourself eg HPI
 
The funny thing is I did a HPI check and absolutely nothing showed up it was a complete waste of £40.00. How I checked out the mileage was I rang VW customer care and quoted the chassis number.
the mad thing about all this is that garages can never go to court over these items as its always dealt with arbritation.

That is very disappointing to hear, sounds like you were aware of the risks and tried to protect yourself but HPI let you down. I wonder if it's something like down here where cars don't need a MOT/NCT for 4 years and they are sold off before there is an offical record of the mileage?

In saying that I thought the HPI had some sort of mileage database linked to main franchises so mileage and service details could be recorded at that stage. Keep pushing that garage for your refund or replacement
 
You are correct in saying it is a huge problem. I have seen it so many times ususally in smaller dealers but sometimes in the larger franchised garages.

I have bought two UK cars but bought them from main volkswagen dealers in Northern Ireland which give a mileage and mechanical guarantee.

Always better importing the car yourself. It is a pity that the government does not do something to eliminate this behaviour as it is simply fraud and theft.

It is also very dangerous as scheduled servicing ie timing belt is not accurate.

I agree stay on top of this garage and when you get a refund go to the press and radio with your story
 
the fact remains that you have had the use of the car for 1 year without issue.... so accept the fact that you won't get 100% equivalent.
 
HPI don't guarantee mileage. It's not their fault.

They check insurance damged or write offs, outstanding finance, and reg. and chassis no. authenticiity.

It's not fair to apportion any blame on them in this case.

It was sold as having 58000 rather than 120000, which has a big impact on the value and price of the car. I would certainly be looking for a full refund.

I don't blame HPI at all. They were no use to me in my case. I found a lot more information by ringing around than they provided to me.

It wasn't without issues, I had many issues with the car and the service that I received from the garage in general. I have spent over €1000.00 repairing parts in the car that needed to be replaced. It was when a main dealer brought to my attention that these parts shouldn't be going is when alarms bells rang.
 
Demand the full amount. And if the garage are a member of SIMI get on to them and watch the garage pay up prompt.
 
ask the garage for a full refund and once agreed in writing make them an offer on the car if your'e happy with it and like it....they can't put it out on the forecourt and try sell it knowing it has an issue with the mileage
 
The garage have claimed responsibility and have offered a full refund. I requested this in writing and Im waiting on the letter today. when I get my money back I want to contact SIMI and if there are any organisations I could contact to stop this fraud. Also they admitted that this is there 3rd car that has come back to them. When i found this out I was furious to why they didn't check to see if mine was clocked. they were just taking a chance the B******S.
 
name and shame and surely the Gardai would be interested and want to investigate .... the best way top get back at these people is to tell everybody you know how you have been treated and what happened.. obviously i am not saying to do it here
