Following company merger my role is being redefined what are my rights?

Hi all,

The company I work for has recently merged with another company resulting in a lot of my colleagues being made redundant. I was interested in the redundancy but didn't get it. As part of the merger I have a new boss (whom I get on very well with BTW), but the problem is that she and I have different ideas as to which direction my career should take. It seems to me that my previous role is being made 'redundant' so to speak, and as such I may be entitled to seek redundancy. I don't have a formal 'job description' that I can refer to in order to clarify this, but I'm going on the basis of 7 years experience doing my job. I suppose my question is: how much can an employer change an employees role before it is considered 'redundant'?

Another grey area is that my 'former' role involved a lot of travel, and as such I have a company vehicle, but my 'new' role involves no travel whatsoever. As I've had the vehicle for over 5 years can the company take it off me as I no longer need it, or do I have rights in this regard? My new boss doesn't have company transport, nor does anyone else in her department.

Any suggestions or comments welcome.

Do you have a contract of employment? If so what does it say about your role and responsibilities? Are you a member of a trade union? Before during and after the merger what communication did the workforce recieve?

I have a contract of employment - but it dates from 1999 and the job description & responsibilities contained in it bear no relation to what I currently do. I never got (or asked for) a new contract to show this. However I'd imagine that my annual reviews for the past 7 years will show how my role has changed.

The vehicle isn't mentioned in the contract either, but the way I see it, the contract is so out of date, it's probably no use to anyone. I got the vehicle as a result of extra responsibilities I took on. If the company were to base any negotiations purely on the job description contained in the contract it would definitely be enough to ensure my redundancy.

I'm not a member of a trade union, but am planning on joining as a result of the current uncertainty. I know it'll take a few weeks before my membership takes effect but I don't see anything much happening until after Xmas at the earliest.

Before during and after the merger communication was/is pitiful.

If you contact the union and explain to them that you wish to join and receive immediate representation most unions will oblige. I have seen this happen on a number of occasions.
