FIS and hours Xmas week

I'm back from Maternity leave since Monday 26th November, so this is my 4th week back. I applied for FIS and was given a date of Sep 7th. I was not paid on maternity leave, recieved maternity benefit of 262. My normal wages average about 350 per week (vary as I'm in retail) so I'm back on that now since I went back. I usually work about 24 hours per week on average, over 4-5 days. This week I am working 35 hours over 5 days. Next week I am working 15 hours over 2 days as the store is closed Christmas Day & Stephen's Day so according to work I've to have those days off along with my usual days off. I will be recieving public holiday adjustments for those two days even though I'm not working.

So I'm just wondering is this going to affect my FIS claim? I've gotten various responses, some seem to think it shouldn't as I can't work Christmas Day & Stephen's Day and still have to get my days off. However I know you have to work 19 hours, but I dunno whether it would be considered that I am "working" those two days as I am recieving adjustments for them?

Or if neccessary would I be able to combine my hours from this week (35 hours) and next week to make up the 38 hours a fortnight. Last week I worked 30 hours so don't really need to combine it with this weeks to fufill the requirements. I know that you're allowed to take your hours over the fortnight... but is there a restriction on which two fortnights can be combined? I mean would I have to combine Christmas week's hours with the following weeks, or would it suffice to combine them with this weeks?

I would appreciate it if anyone could advise me on how this would work and/or if I need to make a new application just because of this one week? Also in the event that I do have to make a new application will I lose all the arrears I have been entitled to thus far? I'm owed a substantial sum at this stage and have been dipping into my savings to keep myself going while I am waiting, so am very worried about losing the arrears. Thanks.

Your hours haven't been reduced below 19 pw (or 38 per fortnight), you just have extra time off because of bank holidays.

You don't need to do anything about your FIS claim.

If your hours were permanently reduced below 19 hrs, you would have to advise the section and you would lose FIS.
