Do I have to pay stamp duty on a property if I have never owned a property in Ireland. I am returning from the UK where I sold my house. I am getting conflicting replies. One Solicitor said I would have to pay stamp duty even though I never owned a property here before. Another said I didn't. It would mean the difference of about €50,000. Please help
The relief is available to persons who have not on any previous occasion purchased or built a house in Ireland or abroad. That disqualifies you. YOu are an owner occupier or investor for stamp duty purposes.
Check Irish Revenue website for more stamp duty details.
An Owner Occupier is a person who purchases a new house/apartment which is to be occupied by the purchaser, or a person on his behalf, as his only or principal place of residence and no rent, other than rent under the rent-a-room scheme, is derived from the property for a period of five years from the date of the purchase.
