Hi Guys,

Our wedding took place last weekend in Galway and a day before the wedding when we gave our final numbers 150, the hotel informed us that we had to pay 160 as this was in the T&C of their package, we actually hadnt received nor signed any T&C we only found out by downloading the package details from their website.

So i initially paid for 155 and now they have come looking for the final 5 head count. Im very surprised at the hotel given the state of the nation etc i thought they could meet half way but again they have contacted me looking for payment, and threating to charge a credit card i used for someone on the night (which i now have cancelled)

Have i any grounds here at all.

Surely if you hadnt signed for a minumum of 160 they cant enforce it - maybe point this out to them

Did you sign up to a specific package? And this package has a number of terms and conditions which state that to avail of the package there have to be minimum amount of guests? If the package makes this clear in its terms and conditions I think hotel are probably within their rights to look for the payment.

Yes we did go with one of their packages but again nothing was really signed between both parties and the only informed us a day before the event never a mention of it before. the hotel had messed up in a few places the best was quoting our guests a different rate than the agreed one e.g. should have been 139 a night and they were initially charging 299 which meant a week and half before the wedding we had 5 guests staying the night we had to correct them on this and inform our guests of the mistake, they didnt even apologise i reckon they were chancing their arms, meant most of our guests had stayed in other local hotels.

Hi Guys,

and threating to charge a credit card i used for someone on the night (which i now have cancelled)

Simon - Even though you have cancelled the credit card they can still charge the payment to it.

Try not to stress yourself too much over this, you are newly married and you dont want to get off to a bad start.

Go to citizen's advise and give them all the details, they will write on your behalf and a compromise will have to be reached.

we actually hadnt received nor signed any T&C we only found out by downloading the package details from their website.

The fact the hotel didn't actually furnish you with the T&Cs doesn't mean they don't apply. You've said yourself, they were there on the website along with the package details.

Yes we did go with one of their packages but again nothing was really signed between both parties

Had the hotel contacted you a week before to cancel your booking and said "well, sure, we've nothing signed with you...", I'm sure you'd have had something to say about it.

I would play hardball if you haven't signed anything. Tell them that if they do charge the credit card, you will dispute the transaction immediately, on the basis that there was no signed agreement. Up the stakes and tell them that you're considering a Small Claims Court claim for the extra 5 places that you've already paid.
