Faulty fridge.

Hi,

We bought a fridge freezer last week. The minute we plugged it in the bulb blew – no big deal. The next day I noticed the milk wasn’t cold just room temp so I thought maybe it needs a day or two to adjust. A week later it’s still the same so I rang the shop were we purchased it. They sent out an eng and he said the thermostat is completely gone and that he will be out next week to replace it. Now I’m thinking maybe we got a completely faulty fridge!

Are we within our rights to ask for a new fridge considering it’s only over a week old and was damaged from the day we got it.

Call the shop back and be persistent. If necessary go in and speak to the manager (on a busy day and loudly enough to be heard!). State clearly what it is you want (a new fridge) and why (it was faulty on delivery).

If it was faulty "on delivery", delivery should not have been accepted.

Thats not a very practical idea. Usually the courier drops this heavy fridge off and then leaves you with it. It's only after the bubble wrap and packaging has been stripped off and the thing has been lifted into place that you can get a chance to plug it in and see whether it works or not.

(That white foamy PVC packaging is so bad for the environment)

This is an extremely practical idea, and a consumer would be extremely lapse in looking after their own interests by not following such an idea.

I presume that the courier that you mention will have a delivery slip that requires the signature of the consumer to indicate that they have received the product, and in good order.

If the consumer is willing to sign this without confirming that the fridge is actually in good order, then that's their look out.

If the courier is supposed to get the signature, then they'll have to wait until the consumer is happy.

And how exactly would you know that the fridge was faulty until it had been plugged in for several hours?

Ehm, the OP plugged it in and immediately the bulb blew. To my mind, the fridge is therefore faulty - and a sign that delivery should not be accepted.
 
I didn't know the fridge was faulty until 2 days after delivery because it was sitting in our new house and we weren't moved in at the time. I should have checked it out but I was on top of my head with the house. I wasn't too bothered by the bulb blowing and it was a day or two later when I realised the fridge was actually not working. It said on the instructions that it would take 24 hrs for the proper temperature to be reached.
Anyway, I just wanted to know am I entitled to look for a new fridge rather than just have it repaired.

Just to update... We rang the shop today and told them about the fridge and without any fuss they said they would exchange it, no problem. All sorted in the end.

Great. Remember - if you don't ask you don't get.

Sometimes you have to ask more than once. I bought a cooked for a soon-to-be-redone kitchen a few years back. It syayed in its wrapper for 5 months, then when i unpacked it - you guessed it, it was faulty! Badly dented in fact.

The shop exchanged it. I had to ask twice; the second time I spoke to the manager and although they tried to refer me to the manufacturer they agreed instantly to a replacement when I pointed out that the contract was with the shop. In most cases, asking politely and repeatedly is all it takes to sort these things out.
