I am currently job-sharing and pregnant. I will be back on full-time wages again before the baby is born and will be paid full maternity leave by my employer for 26 weeks. This will put my income over the €506 weekly income limit for a parent with one child.
According to Dept. of Social Protection
"Under the Maternity Protection Act 1994, a woman who qualifies for Maternity Benefit, Adoptive Benefit or Health and Safety Benefit is entitled to claim FIS (provided she meets the conditions of the FIS payment and has a family – a pregnant woman who has no other children does not qualify for FIS until the birth of the baby). Your income must be less than the income limit for your family size. (If you are claiming Maternity Benefit your average weekly earnings are worked out using your gross earnings to date or your P60)."
If my average weekly earnings are calculated using either my earnings to date or my P60 from last year, I'll be under the €506 weekly income limit, despite the fact that I'll be back on full time wages for about two weeks before my maternity leave will begin and for the full duration of maternity leave.
Am I entitled to make a claim for FIS?
