My mam paid 17,000 in fair deal scheme for nursing home fees for my dad. She did not apply for the loan on the home, she just paid the fair deal amount. Dad was in the nursing home for a few months in 2024. Mam applied for tax back for 2024 but because she hadn't paid too much tax she didn't get a huge amount back. Can she claim these fees against tax paid in previous years? So could she complete a tax return for 2023 for example stating the fair deal was paid in 2024. Seems like tax office told her she could but seems wrong to me?

No. You can only claim tax relief against income in the same year in which the expenses were incurred.

They were either mistaken or your mother misunderstood them.

Actually, I'm not strictly correct here but I'm not sure that the following changes anything in your parents' case?

Health expenses paid over different years​

You may receive health care in one year, but pay for it the following year. In this case, you can choose to claim the relief either in the year you:
  • received the care
  • or
  • paid for the care.
 
My aunt is in a nursing home since mid 2024 and paying her own fees. Is she entitled to tax relief and How can she go about claiming the tax relief on the fees?
She is not availing of Fair deal. We have an EPOA in place. TIA

She has no (never had) a revenue MyAccount set up, nor would she ever be able to do that at this stage. Would EPOA representative have to set it up (EPOA has been registered)? Or would an accountant be best placed using details from the POA? She receives a private work pension.
Has anyone done similar? TIA

This is a separate topic to the original one of this thread but if your mother isn't capable of managing her own affairs, including tax issues, then perhaps the EPOA needs to be invoked so that the appointed attorney can? I don't think that you need to employ an accountant to deal with the tax reclaim. But I don't know the full details of your mother's/family's situation.

Sorry for going off topic.
The EOA has already been registered/invoked. I'd just like to know if others have done it, ie doing Myrevenue on behalf of another to claim tax back on NH fees. Thx.
 
Surely one of the jobs of an EPOA attorney is to do just that - i.e. deal with matters such as Revenue/tax etc. on behalf of the incapacitate person?
