Extension within LA guidelines, mgt agent demanded detailed archi drawings €600.

A couple of years ago I got an extension.

In compliance with my Management company agreement I contacted the managemnet agent to let them know.

I told them at the time that the extension size would be within the council guidelines where I did not need to apply for planning permission.

I was informed at the time by the management agent that they needed a detailed architects drawings before they could give approval.

I stated that the extension would be kept in line with the previous exterior of the house and was told they still needed detailed drawings for foundations etc.

This delayed the whole project a few weeks at a very time sensative time for my family. This also cost me €600 .

Whenever I contacted the management agent again a few weeks later I was told that in fact she had made a mistake and that she had never needed the detailed drawings in the first place as it was within the council guidelines.

I then appealed to get refunded my financial outlay and was told this would have to go to a meeting of the board.

One year later they came back and told me it had been refused when I had already taken it from my yearly fee.

Two years later they are now coming after me for the money and are threatening me with interest.

I just wanted to know what exactly are my rights here.

Any advice would be of great help.

That's a very specific case - I'd be surprised if your lease covered it. They may well be in their rights to charge interest for unpaid management fees - check your lease. Do you have any written records of these conversations?
I would suggest getting a solicitor to take a look.

There are two separate issues here. No1 is the extension and No.2 are the M Fees. They should be kept completely separate, This is where the problem arises.

thanks for the reply purpeller, yes I have 2 letters from the management agent the first one says she referred to a different lease agreement in error and thus provided me with the incorrect info she said she would put it to the board of directors(her words).The second one was because they sent me a statement with the full arrears on it even though she agreed to have my financial outlay reviewed and the board of directors did not have time to discuss at there next meeting.Again she sid this was an error and apologised.

thanks for the reply mercman, I thought this might be the case, but it envolves me going after them for my loss due to negligance which will cost too much for the sum envolved.

The alternative involves them going after you, I would consider letting them chase you for the monies but bear in mind that you could end up with interest and costs.

An alternative solution would be to write a letter to the board suggesting that a legal battle for €600 will be to no ones benifit and that while you are 100% convinced that right is on your side that you would value an amicable resolution and that a reasonable view of the facts surrounding the situation would suggest meeting each other half way.
