Exemptions to the Rent Pressure Zone rental cap:

Hi, could someone please clarify something for me please?

My present tenant is planning to move out of my rented house in the next few months.

If I leave the property unrented for the next two years, can I then start renting the property out again at higher rent then the rent that I am receiving at the moment?

I am asking the question after reading some posts on Boards.ie from 2019 that claim that law isn´t as straight forward as it may seem.

This is what it says on the Residential Tenancies Board website:

Exemptions to the Rent Pressure Zone rental cap:

A property that has not been rented for a period of two years prior to the immediate tenancy commencement date.

As I understand it, any property that has not been rented out for two years is not subject to the rental cap, so there is unlikely to be an issue with this.
This assumes of course that there is no change of govt in the next 2 years. But even there, looking at Sinn Fein's time in government in the north, is marked by a level of inertia that would make Belarus blush, so its possible even they might leave that condition untouched, however they might promise now.
