Hi Guys,

I have a query regarding the erection of a railing over an existing flat roof bay window.

The size of the bay window top platform is about 4mx1m (rectangular)

The railing is 1m high of decorative newel + spindels of hardwood timber and matches the joinery of the external windows and doors of the house.

The bay window platform is adjacent to a first floor bedroom and not a living space.

THIS IS NOT A BALCONY. The railings add to the aesthetic of the house and the existing hardwood bay window below. There is planting on the platform to add colour to the house

Question: is the erection of railings to the rear of a house at first floor level over an existing structure exempted development as described under 41h of the planning acts.

There are no neighbours within 30m of the detached property.

Railings to the side / rear above 2m in height require planning. A quick phone call to your LA should indicate how they would deal with such a request.
