I am the beneficiary of a friends will. Friend passed away in July 2023. Probate granted July 2024. The deceased's solicitor is also the executor. In our opinion he is delaying winding up administration of the estate. He recently said he would release some interim funds, and sent some information to a relative (also a beneficiary). These details (figures) did not add up, so the relative questioned this with the solicitor/executor. He is now saying that he will have to start the administration process all over again - essentially it looks that we will not receive anything in the near future.

Is there anyone out there who can help with this. The solicitor/executor has not been at all cooperative during the probate process and we get stonewalled when ask questions.
 
Do you have a copy of the will? If you don’t and as probate is granted then you can get a cooy from the probate office. Then if your friend left you say €5000 you will get it eventually. But if your friend left you something from the residue of the estate then it will be impossible for you to know how much has been left and all other bills including the non communicative solicitor will be paid first. But if you are a main beneficiary of say property and lots of money or other assets I would find the non communication very difficult.
The executor has a lot of powers in winding up an estate and does not have to tell all beneficiaries what stage they are at.

If you have genuine worries, say you were left a house and it is falling into disrepair or there were strangers living there then you could instruct your own solicitor to send a letter.

Ultimately the only way to enact change is to get the high court to appoint a new executor but that step is so costly it is not to be recommended initially.
