will has 2 executors one is also a beneficiary. this beneficiary has a limited interest in a property for a number of years after which it goes to another beneficiary. if the executor/beneficiary wish to sell the property now and the other executor doesn't as the other beneficiary will no get their full entitlement until the number of years lapses can a sale be force. will doesn't mention selling just passing use of property for a number of years to one and then after that time to the other beneficiary

As in John already enjoys a life interest ? 20 year interest in a property which passes to his brother Michael in 2025. The freehold title was owned by Maria , now deceased. John's interest will lapse in 2025 and go to Michael.

John is a beneficiary and and executor. A third brother, Alan, is the other executor. John wants to sell the property and Alan does not. Can John force the sale?

John can't force the sale as Michael has an interest in expectancy. Unless Michael joins in the sale. But a sale can't happen unless Alan, as the other executor joins in the sale

Op: in short no as its not his to sell as its only a limited interest: Are you Alan, Micael or John?
 
Thanks mf1 - new to this sort of thing..... and Branz, I am Alan and Michael in this case would be a minor ...
