Exclusion from childcare

Hi all, not sure if anyone has any experience with this topic but looking for some guidance. Our child has been attending a childcare facilty for over 5 years on a full time basis since 8 months old. As he moved to school last year we now use their afterschool care 5 days a week. While he was not in their catchment area for school pick up they accepted him as we arranged for him to be brought to the after school ourselves. We have now been advised that he can no longer attend as he attends a school that they do not collect from and want to introduce a pod system based on the schools they collect from due to coronavirus risk. Can they do this? Are they allowed to exclude a child based on school attendance? While we understand the need to control coronavirus, other children are not excluded based on their attendance at other clubs and extra ciricular activities so seems harsh to pick this one measure on which to exclude a child. Our child is devastated as it has really been a second home to him and can't understand why he is being singled out for exclusion.

I would have thought they can 100% do that.

If ‘After School A’ picks children up from Schools B, C, & D, surely they’re free to drop ‘D’ at any stage?

They don't pick up from D. We have always dropped child to creche at our own expense and it has not been an issue before. Now with covid they want to minimise risk based on school they attend. My point is where do you draw the line why not exclude kids whose parents are front line workers as they pose a higher risk to other kids in creche. Seems unfair to exclude one child from friends he has grown up with based one one criteria. I guess children have no rights in this regard. Seems unfair.
 
You could ring the county childcare committee in your county... They could tell you if they are within their rights. There are certainly new guidelines since COVID to try to keep The number of contacts among children as low as possible
 
IF the childcare is a private business they can exclude anyone they like at any time. The new normal is difficult for everyone, they aren't trying to be mean to your child, they have to have protocols in place to minimise risk.

Don't take it personally.

The creche have based their criteria on pods for schools. They have to stick to these protocols for the health of the other children. It is perfectly obvious that a child not attending any of the schools that they usually collect from will be excluded.

A business/ club can't be exhaustive in their list of after school activities, school attended, where they live etc in drawing up qualifying criteria for pods. Otherwise it would be 1 child to one minder.
 
No, it’s not fair, but that’s the nature of the pandemic. Blunt instruments and blanket rulings are being applied because we’ve not had a health crisis like this before.

I heard a mother on the radio last week saying she was considering not letting her immune-compromised five year old daughter go school.

She was wondering what to do!!!!

She’d pre-answered her own question: don’t send her to school.
It wasn’t fair, but that’s just the way it is.
