Colleague who is pregnant at the moment - she is wondering can you take further unpaid leave post the 16 weeks allowed in the maternity act??
 
I presume you are referring to the 16 weeks of unpaid leave allowed under the maternity leave rules? If so then I presume that additional paid or unpaid leave can only be taken with the agreement of the employer.

As I said - presumably only with the agreement of the employer. Certainly no statutory entitlement that I can see.

Any leave taken at any time whether paid or not is always in agreement with employer

Paternity leave is not recognised in employment law in Ireland. In other words, employers are not obliged to grant male employees special paternity leave (either paid or unpaid) following the birth of their child. Annual leave taken following the birth of a child is treated in employment law in the same way as leave taken at any other time of the year. It is at the discretion of the employer to decide who can and cannot take annual leave at a given time.
 
I presume that asdfg meant Parental Leave which is also covered on CitizensInformation. There is a statutory entitlement to this. My earlier comment about no statutory entitlement to additional unpaid leave after the 16 weeks unpaid after maternity leave was in the context of there being no automatic entitlement to extending this as far as I know. Parental Leave is an option but must be agreed with the employer.

AFAIK the employer cannot refuse parental leave. All they can do is postpone it for up to 6 months. They have the option of putting it on their terms, i.e, if the employee wants to take parental leave of 1 day per week, the employer does not have to agree to this.
 
i'm not actually talking about parental leave, i know the ins and outs of that.

what i actually mean is after maternity leave, then the unpaid leave are you entitled to take futher unpaid maternity leave.. nothing to do with parental leave?
 
If you mean do you have an automatic/statutory right to non Parental Leave unpaid leave in such circumstances then the answer is "no" as already stated above.
