Enforcing Terms & Conditions?

Can a company enforce their Terms & Conditions upon you?

1. I never signed anything agreeing to their terms and conditions.
2. I was never sent / given their terms and conditions
3. Their terms and conditions are not available on their website.

The sales person handed me their terms and conditions yesterday and trying to force them upon me. (Because I didn't complain within 3 days of their product being installed, they don't have to supply any missing parts or take back any unordered products.)


Any ideas?

Depends on the circumstances in which the initial contract or purchase was made.

Unordered products is easy , they can't make you pay for them.

The missing goods would still be covered by your normal rights.

Looks like their t&c's are not compatible with the Irish consumer law. The law wins in any argument.
