Hi,

I was made redundant in Jan / 2010, I held a Management position for a UK based company. I was the last to be made redundant and had offered to work for myself as their Irish sales agent, this was declined but I subsequently found out that they had given this to an ex-employee from the UK. For this, and other reasons I have decide to take a case to the employment appeals tribunal - however should I win my case, with the defendant being a UK based company with no operation in ireland, can they be forced to pay me whatever the court awards, or can they ignore the finding?

Am I wasting my time? !!

Dont think you have any right to be selected as a sub contractor or agent just because you were an employee. Can you explain why you consider the two to be connected?
 
I assume you took this matter to a legal professional of some sort and they determined that you have a case. Otherwise I'd agree with number7.
 
You should get legal advice on this as strict time limits apply in relation to employment cases. You need advice on whether you have a case, what type of case and whether you are still within appropriate time limits to bring a case.
 
I have engaged a solicitor to handle my case and we have begun the process with the EAT, he (my solicitor) is away at the moment, so i thought that I would ask the question here ...I don't feel that I have a right to be contractor or agent, but during my redundancy discussions, I suggested that this could be one avenue that would allow me to continue in my role (where I had previosly been quite succesful). I was told that this wasnt an option - after discussing other options including cost cutting, etc, I was made redundant. I subsequently found out that they had already engaged this other party to the role. I have been told that I have a strong enough case based on the manner in which the redundancy was handled ( this issue of contractor will merely serve to strenghten the case) however my question is, should I be awarded a sum by the tribunal, can a company who are based outside of Irish jurisdiction be forced to pay up.?
 
Remember, a solicitor will take on any case as he is getting paid regardless of the outcome.
Has he not answered this very basic question for you ?
 
As I said above, he is away on leave. I can of course ask him when he gets back, but thought in the meantime I would post the question here - I am clearly not going to a straight answer on this forum so will look furthur afield....
