Employer/Employee Problem

Hi All,

I have a small query, I employ an number of people and everyone has an employment contract. It clearly states that conflict of interest or dealing with competitors are not allowed. However I have one employee, whose family have just started in a similar business as myself and he is a director of this company. What am I to do??? Don't just want to sack him and face the E.T., so any advice would be most welcome. He knows alot about my business and keeps asking my drivers about their destinations and his family then follow up these customers. If I say anything he will resign from his company and I have no options left, if I don't he will contuine what he is doing!! I am aware that the employee has some more rights than the employer so any advice would be appreciated.
 
What is your goal - what outcome what you be happy with (since you want to avoid ET) ?
 
why would you be worried about the ET?, if he is in breech of his contract you are entitled to take action against him, the only case he could have is if you did not follow due process and procedures
 
You should be more worried about him taking all of your customers and you company failing.

If you have an adaquate contract he is in clear breach by supporting a competitor!
