EA has exaggerated apartment size

Would appreciate thoughts on this.

We are just about to put our apartment on the market and notice another one in the complex has also just been put on the market. Our apt is about 55 sq metres. The EA has advertised the other apt as 70 sq mtrs:eek:

I'm not overly concerned about the other apt. Ours is in better condition and the other needs work, has storage heating and is ground floor - we will be looking for a higher price. But am concerned naturally that prospective buyers might be put off by our "smaller" apartment with a higher price.

I know they are the same size (I even checked with the builders). Can I/ Should I do anything?

Some clever wording in your adverts could expose the other apartment. Assuming all e.g 2 bed apartments (or whatever they are) are the same size, you could put phrases like these in your adverts - would lead to buyers asking questions:

"2 Bed apartments in this complex are 55 sq m".

"Our apartment is the max size for 2 bed in this block - 55 sq m".
 
do the apts have a balcony/patio area? the EA may have included this in their calculations. We had an arguement with the selling agent for our apt when we bought a few years baxk as they included the balcony measurements as part of the 'living space' making the apt approx 150ft bigger than it is.
 
I emailed them and in their defence they promptly came back, advising they had checked the measurements and they were wrong, and will amend the ad. These aren't new apartments and there aren't any balconies or anything such like to justify the "increase".

Anyway I'll get back to them if I don't see the ad amended.

Its misrepresentation of material fact and is probably illegal

I doubt it - if you read the brochure or online details there is probably a disclaimer basically saying they can say what they want - its up to you to verify/clarify etc.

In the same vein as above, this is meaningless - what if they weren't and you stuck this in anyway?
