Do I owe them?

I'm just back at work after being temporarily laid off for a few months. The company has told me that they mistakenly paid my pension and health insurance during this time, and now say i owe it to them. I presumed that these payments were stopped, which i had no problem with. This is adding up to a lot of money that i can't afford!

Do i legally have to pay them?
 
I would have thought that if you are laid off by them and their accounting is sloppy enough that they don't cease all payments that it's their look out, but I wouldn't be an expert
 
I disagree - people who receive SW overpayments, or health employees overpaid by the PPARS system were expected to pay back, so this isn't much different. you might try to get them to deduct from wages/salary over a year, and maybe ask them to write off a % as they were responsible, something like that?

i know one nurse personaly who was overpaid to the tune of €1000 and did not have to pay it back, though she may well have been "expected to".
 
So I was underpaid for a number of months because my employer made a mistake. I figured that they were entitled to keep the money because I hadn't checked my pay-slips properly. Think about it OP.
 
Hmm, if I understand correctly, YOU never got any extra money from them. It went straight into your pension or health insurance. Perhaps you should suggest to your employer that he asks the pension fund and your health insurance to refund the "wrongly paid money".

You may have to pay them back, but don't cave in too quickly.
 
Are you in a trade union? What were the terms of the temporary lay off? I know of some cases where the company agreed to continue to pay pension and health contributions for the duration of a such a lay off. Did the company make pension and health contributions for other employees?

Incidently if the company are making health insurance contributions then you are liable for BIK on the amount.
