Do all new estates have to provide a proportion of social/affordable housing?

hey

can anyone out there clear up something for me.

i was under the impression ALL new housing estates had to give up a preportion of houses to the government for affordable housing etc...

i didnt think theu built council estates anymore..

reason im asking is builder of an estate i was looking at said they gave no houses to local schemes...

Any ideas?

I could be wrong but I think some developers were allowed to buy their way out of this scheme or provide the percentage of affordable/social housing in another one of their developments elsewhere. This was only allowed by some county councils/corporations- not all and I believe the practice may now be being clamped down on.

Someone else might be able to provide more accurate info- but I did hear that the above practice was going on..

The developers are usually obliged to give 20% of the houses towards Social and Affordable. But this can be replaced with an appropriate cash payment or an offer of alternative land in a suitable location in special circumstances (e.g. a development of very up market houses where it would not be in keeping with the development to have "more affordable" houses contained within it).
 
It is no longer possible for developers to provide a cash contribution instead of housing units. This follows from a high court case with Rathdown DunLaoghaire last year.

Previous to that, a lot of councils requested cash payments rather than housing units. It really was up to individual councils in negotiation with each developer.

They must now be given houses, the number is determined under the Part V rules (c. 20% of the difference in value of the land before planning and after planning)

There may however be some developments where agreements were made before the above court case but have not yet been completed so they may be giving cash payments instead.
 
So how do you actually go about finding out that there are units available in a new development under this scheme. How much cheaper does anyone know would a house seling for €185000 be under this scheme?
 
The amendments to Part V in the 2002 act allowed developers different options for complying with their Part V obligation such as off-site provision of houses or land or cash compensation so not all estates will have social and or affordable as it depends on the local authority and each development is dealt with on a case by case basis
