district court debt-means assesment

if you are summoned to court for means assesment and lodge your means within the period given, and attent the court on the day with the summons etc, but the other side or thier solicitors fail to turn up--what happens ? i was summoned to appear on 9/5/2011. no show other side--then i get another summons lodged with the district court on 16/5/2011 --7 days after i appeared to again lodge my means and appear in july ? why so. and what do i-or can i do ? regarding this fiasco ?

Simply ask the Judge to dismiss the case. with no one to argue the judge should do it no problem

the judge simply smiled, handed me back the summons-he had none before him ? and the documents i had lodged and go--but didnt hear him dismiss the case ?
