Disqualified period based on Gross or net redundancy payment ?

Hi there ,

Was made redundant end of last month . On first of July went to SW local office to register . I was told by officer , I will be disqualified for 4 weeks based on the rule bellow (Copied from key post) :

You will be disqualifed from receiving benefit for the following periods, depending on the amount over 50k you receive in redundancy payment;
  • €50,000.00 - €55,000 1 Week
  • €55,000.01 - €60,000 2 Weeks
  • €60,000.01 - €65,000 3 Weeks
  • €65,000.01 - €70,000 4 Weeks
  • €70,000.01 - €75,000 5 Weeks
  • €75,000.01 - €80,000 6 Weeks .
Today, I received a letter from SW stating that I won't be able to claim JS allowance for 2 more weeks (total 6 weeks since I was made redundant) as the redundancy payment is based on the gross amount I received not the net that was paid into my bank account .

Is that how it should be calculated , based on gross redundancy payment or net ?

In my case the redundancy payment consist of :
- Statutory payment
- Minimum notice
- Severance Pay in Lieu of signed waiver

Does the redundancy payment includes the minimum notice also ?

It is based on gross. See http://www.welfare.ie/EN/Pages/jajbfaq.aspx#q12

Quote- "This disqualification applies only to persons who are:
  • under age 55, AND
  • have received or are entitled to a payment in excess of €50,000 under the Redundancy Payments Acts or under an agreement with their employer. This amount includes the gross amount of all payments in respect of the redundancy, e.g., statutory redundancy, top-up or ex-gratia payments related to weeks of service, early encashment of pension entitlements (if from employer's funds) and any other money received under an agreement with the employer."
Also "In cases where the customer intends to use some of the redundancy payment to clear or reduce debts which have accrued, it is reasonable for Deciding Officers to offset these debts against the amount received before determining an appropriate period of disqualification, e.g. arrears of mortgage or rent, arrears of telephone/electricity/gas bills and particularly debts to moneylenders. Regard may similarly be had to costs related to any exceptional needs, e.g. the cost of converting the customer's home to facilitate wheelchair access by a family member."
