Dispute with Online Retailer

Hi

Anyone got any experience / helpful links for dealing with a dispute with an online retailer (UK based) ?

Sorry, bit of a rush job and under pressure but in short:

- retailer claims I purchased different goods to those I did ask to purchase (done over telephone so no hard evidence) & tried to push these goods on me

- retailer claims I'm wrong in my order, but I'm entirely clear & can support with a follow up e-mail where I made referance to the purchase I made, not the one they now claim I made

- relatively large sum involved & product I want not available elsewhere (I desperately need the product, so the retailer has me somewhat over a barrell)

- retailer forcing the price up, to now supply the product (hundreds of euro in the difference)

- retailer issued incorrect invoice which took a number of days to arrive in Dublin, by which time it was too late as payment was fully made to retailer ... I had corrected the retailer's staff member on the phone, when the original order was placed by the way, but it still issued incorrectly.

Ultimately, I want to force the retailer to honour the original contract but there is a seriously tight timeframe involved, which puts further pressure ( sadly, on me ! )

Have you payed by credit card?

If so I believe you can ask the credit card to reverse the payment as the retailer hasn't stuck to his side of the bargain... search for info on this as I only read it in a thread but it seemed to work for some people... actually I just remembered that it was a thread about Swedex windows and how they were closing down, people who'd payed by credit card had some comeback....

Thanks for this, though in this instance I really want to force them to honour the contract rather than just get my cash back .... trust me, if I could get what I need elsewhere, I sure would and take the cash back immediately but in this instance, I'm stuck between a rock & a hard place

The general principle in Irish consumer law is that the retailer's obligation is to repair, replace or refund. I don't think you can 'force' them to complete the transaction.

Yes, I think your correct - in terms of consumer legislation, although I had hoped to be able to "nail them" for breach of contract or something, though sadly there is a cost-vs-return thing to consider, before charging off to the High Court etc.
