A friend of mine is on disability allowance for the last 3 years after a car accident, she is hoping that in another year she might be able to try and do most part time work as she is currently unable to.
When she returns to part time work does she have to pay back the disability allowance to the state?
She has a legal case pending and is hoping to have that settled - when she receives this settlement will she have to pay back the disability?
She also has a medical cad now and wants to know how this will be affected when she goes back to work or gets her settlement?

Your friend won't have to pay back disability allowance if she stops claiming it when she regains her health and resumes work. She was entitled to it for the duration of the claim.

I'm not aware of any rule which would mean she'd have to pay back the money if she receives a settlement. Disability Allowance should be declared for the legal case (if suing for loss of earnings, it would be taken into account when determining the final figure if successful).

A medical card is means-tested and will be reviewed if she begins work and/or has savings/investments (which she would have if the settlement comes through).

It is possible to work or re-train while keeping DA. If the work is of a rehabilitative nature, or if the person begins a training course to re-train before returning to the workforce, some of the income from that may be disregarded when re-assessing DA entitlement. Check with DA in Longford before beginning a course/job.
