Developer has sold apartment to someone else

The EA has just rang us to say that the developer has sold the apartment to someone else. We had paid the booking deposit three weeks ago. I can't understand why it has to our apartment. Thay are saying we can have first refusal on the next lot but will not guarentee the price yet.
Our solictor has said there is nothing we can do, it just seems so unfair.
 
Sounds like you have been "gazumped". It's unfair but I don't think there is anything you can do about it.
Paying a booking deposit guarantees you virtually nothing.
 
If the developer is Homebond registered are they not obliged to hold the property for 30 days?
 
Thank you both for your replies, I know the current law also favours the buyer if they change their mind but I still think its pretty poor especially as deposit was paid three weeks before. As it was at the top end of our budget , I have pleaded with the EA to ask developer to let us have one at same price and he is thinking about it over weekend. Am pretty sure it won't work but at least we tried everything.
 
Yes, get a date for the interview and relay that to the developer via the EA. He sure will change his tune then. If not, then other buyers in the development might consider their position or even hedge their bets by putting a deposit on a different scheme
 
Thank you for the replies. They did not ring so for our own sanity , its probably best to move on again......... Husband went out again on Sat and we are now sale agreed again (third time lucky:) ) but this time will not stop viewing until contract is signed.

Cheers for the reply !...Wow. I am starting to worry now !.. As i put 5k down for an apt off the plans etc....Rang the agent today and they said the contract are be sent out on monday and tuesday of next week.

How come they sell the apartment to someone else..?..i wonder is it financial or personal reason?

Maybe i should go apartment hunting ?
