Demanding a refund for a service

Hi,

I recently found myself in a situation where I had to demand a refund for a service I had paid for which was not provided satisfactorly. I spoke to the citizens advice free legal aid service and they advised me to write to the service provider outling my complaint and asking for a refund of a potion of the fee I paid. This portion was 3/5's. I have just had a response (right up agianst the deadline I set) offering me half of this again as there was VAT applied to the original transaction. Is this a valid argument? As a business they are entitled to claim VAT back where as I am not, why should I bear the cost of this? I would pay the VAT on the portion I am allowing them to keep.

I think I would do better in small claims court as my advice tells me they dont have a leg to stand on, but I dont want to be unreasnoble.

Any Advice?
