Ok, i'll try to make this as to the point and factual as possible...
In April 2009 I purchased a system from dell on a credit loan agreement from CIT Finance for the pricely sum of €2534.00 yes pricey but all was well and good at the time.
The agreement was 36 monthly payments of €70.40...
Now im a full time student, part time working.. and in the summer of 2010 i fell into arrears of €170, i contacted CIT, and explained my situation, they were very helpful and i cleared the arrears and changed my payment plan to be €25 weekly instead of the monthly payment. This was no problem to CIT..
However, in sept, with college fees etc, there was a week where i couldn't afford the standing order, and i placed it on hold, not having credit mean't i couldn't inform CIT, but i said to myself i'll resume the standing order next week, well with getting back into final year and study i forgot to reinstate the standing order....
CIT never contacted me, instead, i received a brutish phone call from BPO a debt collection agency in Glasgow on the 15th of october. They woke me up and i was well still half asleep while they were roaring down the phone in Scottish, it took me a week to figure out the name of the company because i couldn't understand them on the phone. They wanted an immediate payment of €1000, or €200 a month for 6 months... i said i wasn't in a position to do either, i said maybe the 200 was a possibility but to get back to me on friday...
Friday came, my phone did not ring i simply got a voice mail saying to contact them, its a 0044 number so whatever my phone would do it would not dial that number..
The following wednesday i was phoned, in the am, by the same brute, saying that i had breached contract by not paying 200 on the previous friday, stating that all calls are recorded and i made a verbal contract to pay a now 233 as i was informed on friday, i queried the 33 and iwas told that the 200 i was quoted was in sterling, well i said i never agreed to pay, and i want their address so i can foward an offer of payment, he said "no we won't b doing that, we will be taking this matter further, you'll recieve a letter" and hung up
In the pm of the same day a woman fromt he same company rang me, and was half way into her shpeel that she was from bpo when she abruptly said "oh you've already been contacted today" and went to hang up, i asked her for a few moments of her time and she was just as rude as her colleaugue, i tried to make an offer of payment, she said no, no and no, with great work, i made an offer saying that i would pay €25 weekly until the end of november where i would pay a lump sum amount to the total oustanding from €1000. She half heartidly agreed, and said right ull need our banking details then... she gave me only half the details and hung up... so i couldn't make a payment, and still no address
a week later she rang again and said i had not paid i said yes of course i havn't i need ur address, and you didn't give me it after i asked repeatedly, she said right sir i'll be taking that as a refusal and she hung up...
I recieved a formal notice in the post from them the morning of the last said phonecall armed with their address i wrote two formal letters, firstly, quering the amount owed, and quoting the non fatal offenses against the persons act requesting all future contact to be in writing, including that i had made an offer of payment but said offer was unfacilitated, and that i was currently reviewing my financial situation and would make an offer of payment should i be satified with the financial breakdown of the amount owed.
I also wrote a letter of complaint regardign the way in which i had been dealt with. The man i was speaking to made numerous references to the collection of my laptop as payment which is insane becasue its a credit loan agreement, the laptop is mine, the debt is theirs for me to clear.
I did also contact the origional creditor CIT in regards to it, the did indeed sell the debt on, however... BPO constantly refers to CIT as their client, which tells me the debt is not sold, they are merely hired to collect the debt.
I sent the two letters 3 weeks ago now, since then, i have recieved two warnings from BPO, but no statement of account, no respnse to my letters, yesterday i recieved a final notice saying that they would be in talks with their client as to weither or not they would be taking legal proceedings against me, saying that enforcement alternatives could include attachment of my earnings and or arrestment of my bank account
they now require settlement in full by the 22 of november... to the principle sum of €1392.00
its my legal right to a breakdown of that €1392.00.. i havn't gotten it
