deeds,owner occupier 1st stage payment

Just wonder at what stage does one become an owner occupier??? when site put in my name or final stage payment to builder???

my builder looked for over half the house price as the first stage payement

i asked my solicitor for the site on which the house stands to be put in my name at that stage feb 02

i did not actually get keys and move into the house due to delays until nov 03

i must be 5 yrs owner occupier before i can rent out house (other than rent a room scheme) without incurring investor stamp duty

I have come across this before and the answer I was given by Cork Stamps Branch is that the applicable date is the date of the Deed of Transfer or Lease.
